Health Law (Representation of Health Care Providers):

  • Dismissal of license revocation proceedings brought by TDHS (now DADS) and award of approximately $300,000 in attorneys’ fees to facility based on falsified records to support enforcement action (Travis County)
  • Permanent injunction against DADS to bar inclusion of Quality Assurance data in nursing home survey reports and to prevent using Quality Assurance data in nursing home enforcement proceedings (Angelina and Travis Counties)
  • Dismissal of Immediate Jeopardy nursing home citations (statewide)
  • Removal of deficiencies from survey reports (statewide)
  • Dismissal of enforcement remedies and monetary fines proposed by state and federal licensing agencies (statewide)
  • Dismissal of Medicaid fraud allegations (Van Zandt and Dallas Counties)
  • Dismissal of charges against nurses, nursing home administrators, nurse aides, emergency medical technicians, paramedics, physicians, and other health care providers before their licensing boards
  • Recoupment of monies owed to nursing homes following successful challenges to TILE audits (Dallas and Panola Counties)

  • Defense no liability verdict in nursing home wrongful death case alleging failure to treat urinary tract infection and sepsis (Hidalgo County)
  • Defense no liability verdict in nursing home wrongful death case alleging failure to prevent and to treat pressure sores and malnutrition (Travis County)
  • Defense verdict in home health agency case alleging failure to recognize and to treat bacterial infection of the colon (El Paso County)
  • Defense verdict in assisted living facility case alleging failure to prevent, diagnose, and treat fractured neck (Potter County)
  • Defense verdict in a nursing home alleging failure to treat and medicate a cancer patient (Pecos County)
  • Defense verdict in home health agency
  • Defense verdict in an independent living facility case alleging failure to treat a resident who fell from a chair  when the electric elevated chair lift malfunctioned

Personal Injury Litigation:

  • $100,000 plaintiff’s verdict against Wal-Mart based on premises liability in slip and fall case (Limestone County)
  • Defense verdict in premise liability case alleging failure to maintain a sidewalk resulting in a fall and fracture

Contracts:

  • $85,000 jury verdict against special utility district for breach of water services agreement (Williamson County)
  • $100,000 settlement in case against home owner’s association regarding restrictive covenant enforcement and diminution in property value (Travis county)
